Complaints Procedures

1. Appeal Against Refusal to Register

Section 46 of the Enviromental Assessment Act, 2011 (and Article 44.1 of the BEAPA Constitution) advises that a person aggrieved by a decision of the Board to;

  • Refuse to register the applicant;
  • Suspend their registration;
  • Remove them from the Register;

may, after giving written notice of the intention to appeal to the Board's decision, and within thirty (30) days of the date on which notice is given to him or her by the Executive Secretary of the refusal, suspension or removal, appeal to the High Court.
